Terms & Conditions

1.0 Definitions

1.1 The following word and phrases shall have the following meaning unless the context require otherwise:
“The Company” means BBG Interiors & Design
“The Customer” means any company, firm, individual or agent thereof to whom this document is addressed.
“The Goods” means the products, goods services and other items or materials to be supplied by the Company to the Customer.
“Contract” means any contract concluded between the Company and the Customer for the sale of Goods.
“Orders” means an order placed by the Customer, accepted by the company and giving rise to a contract.

2.0 Orders

2.1 The Company is not obliged or bound to accept any orders
2.2 The Company reserves the right to withdraw any of the Goods from the design at any time without notice.

3.0 Delivery

3.1 Any statement issued by the Company as to the date of delivery shall be treated as an estimate only. While the Company will endeavor to ensure delivery by the stated date the Company shall not be liable for any loss or damage arising out of delay or failure to delivery by the said date.

4.0 Price

4.1 Unless otherwise agreed the price shall be that as stated on the pricing schedule as agreed between the Company and the Customer.
4.2 Some prices may be marked as “estimated” and the Company undertakes to advise when it is anticipated that this estimated figure would be exceeded.
4.3 Once the design has been agreed any changes thereafter will be charged at the hourly rate of £35.00/hour.

5.0 Terms of Payment

5.1 Failure to make payments for the Goods will mean that the Company reserve the right to withdraw the order
5.2 All Design work and Project Co-ordination work shall be paid by the Customer to confirm the order of goods.

6.0 Matching

6.1 While every effort is made to achieve the closest possible colour matching on fabrics and paints, the Goods are sold on the understanding that exact matching between batches of co-ordinated products cannot be guaranteed.

7.0 Returns

7.1 Bespoke Designs and Project Co-Ordination schedules will not be accepted for return under any circumstance.

8.0 Cancellation

8.1 If the customer cancels the order after 7 days a refund will be given minus cost for any work incurred by the Company.

9.0 Design Copyright – All rights reserved

9.1 The Company owns the copyright in the designs produced in the performance of the Services and generally asserts the Designer’s moral rights and all other rights to be identified as the author of the designs.
9.2 For avoidance of doubt no part of the Company’s designs shall be registered by the Customer without the consent of the Company in writing.

10.0 Liability

10.1 The Company will not be liable to the Customer for loss, damage, costs, legal costs, professional and other expenses of any nature whatsoever incurred or suffered by the Customer or by any third party arising there from.
10.2 Before relying on any information given by the Company the Customer should seek confirmation from Appointed Companies or individuals who are solely responsible for the services.
